Agreement
By creating an account or using OneMoreBonsai (“the Service”), you agree to these Terms of Service. OneMoreBonsai is operated by Max Yodgee, an individual based in Australia (“we”, “us”, “our”). If you do not agree, please do not use the Service.
Your account
You are responsible for keeping your account credentials secure. Please use a strong password and do not share your account with others. You are responsible for all activity that occurs under your account.
You must be at least 13 years old to use OneMoreBonsai. By creating an account you confirm that you meet this requirement.
We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behaviour, or are used fraudulently.
Your content
You own all the content you create in OneMoreBonsai - your tree records, care logs, notes, and photos. By uploading content you grant us a limited licence to store and display it as part of operating the Service. We will never use your content for advertising or share it with third parties without your permission.
You are responsible for ensuring you have the right to upload any content you add. Do not upload content that infringes on someone else's intellectual property rights.
You can export your data at any time via the Export section in Reports. If you close your account, we will delete your data in accordance with our Privacy Policy.
Acceptable use
You agree not to use OneMoreBonsai to:
- Upload unlawful, harmful, or offensive content.
- Attempt to gain unauthorised access to other users' accounts or data.
- Interfere with or disrupt the operation of the Service.
- Use the Service for any commercial purpose other than managing your own bonsai collection.
- Attempt to reverse-engineer or copy any part of the Service.
Subscriptions and billing
OneMoreBonsai offers a free tier and paid subscription plans. Paid plans are billed monthly or annually via Stripe. By subscribing you authorise us to charge your payment method on a recurring basis until you cancel.
You can cancel your subscription at any time from the subscription page. Cancellation takes effect at the end of your current billing period - you retain full access until then. We do not offer refunds for partial periods, except where required by Australian consumer law.
We reserve the right to change pricing with reasonable notice. We will notify you by email before any price change affects your subscription.
If your payment fails, we will attempt to notify you. Access may be restricted if payment remains outstanding after reasonable attempts to collect it.
Australian Consumer Law
Nothing in these terms is intended to exclude, restrict, or modify any rights you have under the Australian Consumer Law (ACL), including any consumer guarantees that cannot be excluded by contract. To the extent that any provision of these terms is inconsistent with the ACL, that provision is modified to the extent necessary to comply.
Limitation of liability
OneMoreBonsai is provided in good faith but on an “as is” basis. We do not guarantee that the Service will be uninterrupted, error-free, or that data will never be lost. You are responsible for maintaining your own backups of important data - the Export feature is there for exactly this purpose.
To the maximum extent permitted by law, we are not liable for any loss or damage - direct, indirect, incidental, or consequential - arising from your use of or inability to use the Service.
This limitation does not apply to any liability that cannot be excluded under Australian Consumer Law.
Intellectual property
All code, design, and original content that makes up OneMoreBonsai (excluding your personal data and content) is owned by Max Yodgee. You may not copy, reproduce, or distribute any part of the Service without written permission.
Privacy
Your use of OneMoreBonsai is also governed by our Privacy Policy, which forms part of these terms.
Changes to these terms
We may update these terms from time to time. We will notify you of significant changes by email or by a notice in the app. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
